ASTRA is a super strong expedition vessel that can go anywhere in the world, regardless of the weather. After completing her 151 day circumnavigation via the five southern capes in May followed by an extensive shipyard period she is ready to depart for Antarctica or the Northwest Passage. 

In Dag Pike’s article on ASTRA in Passagemaker magazine in March 2018 he said:  

“... I would put this 80-footer in the category of the ultimate passagemaker - a vessel capable of taking on the world’s toughest oceans and coming out on top. She has to be one of the toughest boats of her size ever built... with traditional sheer lines and purposeful superstructure. No frills here, just a proper functional boat built for one of the toughest jobs in the world ”.

ASTRA is a 23.35 meter customized polar expedition vessel with the highest ice class rating and ice breaking capability. All this on a vessel that is just below 24 meters in length and also European CE certified.

According to construction drawings on board (and confirmed by thickness measurements carried out during the survey in September 2020), the hull shell plating thickness varies from 15mm on the bottom plates tapering through 13, 11 and 9mm on the outer shell plating and deck areas. UTI testing (Sep 2020) indicated less than 4% reduction in the original shell plating, in part attributed to ASTRA having operated in fresh water in the Baltic for her initial 22 years.

She is powered by a low/medium speed Mitsubishi main engine (M.E.) of 1,350 BHP, that is started by compressed air at 30 Bar, in the same manner as a merchant vessel. You do have to remember that ASTRA was built as strongly as was feasible for a vessel of her size and she is a big step up from the small scale electrics and battery starts commonly found on other vessels below 24 m.

The main engine goes through a 3:1 reduction gearbox, reducing the RPM at the propeller to 1/3 of that at the engine. The propeller shaft is approx. 12” in diameter and, on seeing it, you start to get a real sense of her strength and design capability for adverse weather. The propeller itself is a 4 bladed controllable pitch propeller (CPP) of 1.72 m in diameter and the rudder is a high performance Schilling rudder (+/- 64°) that can be operated either hydraulically or electrically.

The Schilling rudder, combined with a 100kw hydraulic bow thruster, provides incredible maneuverability for a vessel of ASTRA’s size. Fitted with 4 conning positions from the navigation bridge, the vessel can be handled from Port, Centre and Starboard (looking forward) and the centerline aft when maneuvering astern.

Anyone that has ever owned a SAAB or VOLVO will have had the opportunity to appreciate Swedish engineering. A substantial hydraulic system is at the heart of the ship’s systems on ASTRA and hydraulics power the following systems: - Bow Thruster - Anchor Windlass - Towing Winch - Stern Flap - Forward Crane - Aft Crane - Fire Pump

The key systems on board are provided with a back-up system that provides 100% redundancy, including: - Engines - Steering - Bilge Pumps - Air Compressors - Power Generation.

Built as a rescue vessel, ASTRA is incredibly stable and has no ‘point of vanishing stability’. When fully laden, with all tanks full, she still has a GM of 0.98m.

In addition to air conditioning, ASTRA has substantial heating capability from her CTC boiler (that can run electrically or from diesel) and is very cozy onboard, with ample heating radiators and lots of hot water. Heating is one of the areas where her ice class comes in to play, with heating blowers in the foc’sle store and steering flats, hot water discharge points from the engine cooling discharge to deck if required for clearing ice (lancing) and, running just below the bulwarks, is a heating coil for clearing ice from the scuppers. This has stainless steel pipework, as is common for the majority of systems onboard.

During ASTRA’s refit in 2017, aside from the work you might expect in a repair period, the following major additions were made: - Air conditioning in all areas - new Portuguese bridge - new Furuno navigational equipment - new 4 automatic rotating stabilizers - large additional battery banks (to be able to lie at anchor without auxiliaries)

- increased fuel capacity

- fresh water maker

- new oak cabin soles - new toilet and shower facility on the lower deck

With the new MagnusMaster rotating stabilizers fitted in Sep 2017, even in seas of 4-5 meters in height and it was remarked that “... this went largely unnoticed, with coffee cups staying firm on the table and the passengers able to get on with their normal activities. The vessel was only moving steady slightly up and down without rolling side to side ”.

ASTRA's owner is a Master Mariner who has prepared her to an extent this broker has never seen aboard any yacht. She has my absolute highest recommendation. It has been a highlight of my career assisting with her purchase and now an honor to represent her.

ASTRA's engine room occupies over half her length with plenty of room to work around for maintaince. Located amidships/aft, the engine room is an ideal location to work in almost all weathers. The electrical switchboard and new 23 kW Cummins Onan genset are in the control room removed from any contaminants. In the event of an engine room fire, the genset would be safeguarded and would be able to provide electrical power for communications and navigation equipment. Access to the Engine Room is through watertight doors leading to the control room and the workshop. An escape hatch to the aft deck is also provided. A soft patch is fitted around the escape hatch to facilitate removing large equipment from the engine room.

There are 3 sources of generating power from the shaft generator, Volvo Penta and Onan.The 2021 MECC ALTE 50 kVA shaft generator is a big plus in that the running hours on the other generators is not increased and it is so amply sized that it can power everything on board.

A last generation mechanical engine, the MITSUBISHI at 8 tons is an incredibly large engine for a vessel of this size. It is coupled with a very heavy duty gearbox and 1718 mm controllable pitch propeller in a 2021 nozzle. If there was an issue with one cylinder head you can work on that cylinder on its own rather than having to lift the whole bank of cylinders.

The water maker only needs to run four hours daily for the ship's complement's needs and Silver-ion dosing of the fresh water ensures purity. Two complete independent air-conditioning systems provide 100% redundancy.

The workshop, with ample space to carry out repairs even has a lathe and proper drill press.

There are two separate systems (Main Engine or Volvo) to run the hydraulics and the Volvo Penta also provides get home power to the main shaft.

ASTRA has one electric and one hydraulic steering pump.  Having one that is hydraulic, powered off the main engine, means there is less electrical demand for the generator. The hvirtually maintenance free rotary vane steering gear requires less space to fit and there is not the associated hydraulic oil leaks that occur with steering gears of the hydraulic ram type.

Following her circumnavigation all equipment was fully serviced.

ASTRA's accommodations are appropriate for a polar exploration yacht with low maintenace in mind and comfort at sea.

On the maindeck are the saloon, galley, laundry, skipper/owner's cabin and large toilet compartment with stall shower.

Three watertight doors lead to the decks. There are external stairs to the engine room and also the wheelhouse. There are four double cabins on the accommodation deck along with another toilet compartment with stall shower. In 2021, the lower saloon as shown on the attached drawings has been replaced with a 1500 litre freezer and lockers sized for long life milk containers and dry stores.

During the circumnavigation, the crew enjoyed freshly prepared meals in all conditions as the galley is highly functional with the cook kept secure.

During the circumnavigation, the crew enjoyed freshly prepared meals in all conditions as the galley is highly functional with the cook kept secure.

ASTRA's engine room occupies over half her length with plenty of room to work around for maintaince. Located amidships/aft, the engine room is an ideal location to work in almost all weathers. The electrical switchboard and new 23 kW Cummins Onan genset are in the control room removed from any contaminants. In the event of an engine room fire, the genset would be safeguarded and would be able to provide electrical power for communications and navigation equipment. Access to the Engine Room is through watertight doors leading to the control room and the workshop. An escape hatch to the aft deck is also provided. A soft patch is fitted around the escape hatch to facilitate removing large equipment from the engine room.

There are 3 sources of generating power from the shaft generator, Volvo Penta and Onan.The 2021 MECC ALTE 50 kVA shaft generator is a big plus in that the running hours on the other generators is not increased and it is so amply sized that it can power everything on board.

A last generation mechanical engine, the MITSUBISHI at 8 tons is an incredibly large engine for a vessel of this size. It is coupled with a very heavy duty gearbox and 1718 mm controllable pitch propeller in a 2021 nozzle. If there was an issue with one cylinder head you can work on that cylinder on its own rather than having to lift the whole bank of cylinders.

The water maker only needs to run four hours daily for the ship's complement's needs and Silver-ion dosing of the fresh water ensures purity. Two complete independent air-conditioning systems provide 100% redundancy.

The workshop, with ample space to carry out repairs even has a lathe and proper drill press.

There are two separate systems (Main Engine or Volvo) to run the hydraulics and the Volvo Penta also provides get home power to the main shaft.

ASTRA has one electric and one hydraulic steering pump. Having one that is hydraulic, powered off the main engine, means there is less electrical demand for the generator. The hvirtually maintenance free rotary vane steering gear requires less space to fit and there is not the associated hydraulic oil leaks that occur with steering gears of the hydraulic ram type.

Following her circumnavigation all equipment was fully serviced.

  • Two LEROY SOMER 400 VAC 2.2 & 5 kW air compressores for the main engine controls and starting and for the air outlets.

The 55m/180'5" motor yacht 'Astra' was built by Amels in the Netherlands at their Vlissingen shipyard. British tech entrepreneur Mike Lynch, his lawyer and four other people are missing after a superyacht carrying 22 people sank off the coast of Sicily, authorities say. 

Fifteen people, including Mr Lynch's wife, have been rescued after the boat was hit by a violent storm at sunrise, according to the Italian Coast Guard.

Divers had located the wreck 50 metres underwater and search operations are continuing.

Mr Lynch's wife and 14 other people were rescued, including a one-year-old girl, and one person has died.

A person familiar with the rescue operation confirmed to Reuters that Mr Lynch's 18-year-old daughter Hannah has not been accounted for.

The British-flagged, 56-metre Bayesian had a crew of 10 people and 12 passengers, representing British, American and Canadian nationalities, the Italian Coast Guard said.

Managers of the sailing yacht Bayesian, Camper & Nicholsons, confirmed to the ABC that the Bayesian encountered severe weather and subsequently sank near the Sicilian capital Palermo, Italy, at 4:30am Monday, local time. 

"Our priority is assisting with the ongoing search and providing all necessary support to the rescued passengers and crew," they said. 

Fifteen people were rescued and taken to shore at Porticello, where eight were receiving treatment in hospital and remain in a stable condition, the Italian Coast Guard said.

One body has been recovered and police divers were trying to reach the hull of the ship, which was resting at a depth of 50 meters where it had been anchored.

British Bill Gates missing

Mr Lynch is often dubbed by UK media as "the British Bill Gates" and the BBC confirmed the luxury yacht was tied to his wife, Angela Bacares.

According to maritime data service Equasis, the owner of the the Bayesian is listed as Revtom Ltd, the BBC reported.

Additionally, the yacht's name would resonate with Mr Lynch because his PhD thesis and the software that made his fortune was based on Bayesian theory.

Mr Lynch was acquitted in June by a jury in San Francisco of fraud charges linked to the sale of his software company, Autonomy, to Hewlett-Packard for $US11 billion ($16.4 billion) in 2011.

He said at the time that he was "elated" to be cleared in the criminal trial in which he denied any wrongdoing, and blamed HP for botching the integration of the two companies.

In a separate incident, Mr Lynch's co-defendant in the trial, Stephen Chamberlain, died on Monday after a road accident left him critically injured.

Mr Chamberlain — Autonomy's former vice-president of finance alongside Mr Lynch — had been placed on life support after being hit by a car in Cambridgeshire on Saturday morning.

Rescued baby held above waves 

The coast guard said that rescue efforts had located the wreck at a depth of 50 metres underwater. 

The Italian fire and rescue service agency said search operations at sea were continuing with the coordination of the Italian Coast Guard, in a translated post on the social media platform X. 

One of the survivors, identified only as Charlotte, said she had momentarily lost hold of her 1-year-old daughter Sofia in the water, but then managed to hold her up over the waves until a lifeboat inflated and they were both pulled to safety, Italian news agency ANSA reported.

A spokesperson for the UK's Foreign, Commonwealth and Development Office said they were providing support to British nationals.

"We are providing consular support to a number of British nationals and their families following an incident in Sicily, and are in contact with the local authorities"

Captain of nearby boat helped rescue passengers

The captain of a nearby boat that helped to rescue passengers from the Bayesian said that when the storm hit he turned his engine on to keep control of the vessel and avoid a collision with the Bayesian.

"We managed to keep the ship in position and after the storm was over, we noticed that the ship behind us was gone," Karsten Borner told Reuters.

He said that his crew then found 15 survivors on a life raft, including three who were seriously injured and took them on board before the coast guard picked them up.

"There were 15 people inside," he said.

"Then we communicated with the Coast Guard and after some time, the Coast Guard came and later picked up injured people, and 2 hours later they picked up the other people."

Mr Borner said "a little baby and the wife of the owner" were among the survivors, while the owner of the sunken ship and another child were among those missing.

He described the conditions as "very strong" and said that his vessel was "heeling" but the Bayesian "went flat on the water and then down".

"There was a light and we saw that the ship was aside and then we saw a triangle," he said.

"So I think she went back down."

Storms and heavy rainfall swept Italy in recent days

Prosecutors in the nearby town of Termini Imerese have opened an investigation to look into what had gone wrong.

"The wind was very strong," a coast guard official in Palermo told Reuters.

After weeks of scorching heat, storms and heavy rainfall have swept down Italy in recent days — with floods and landslides causing major damage in the north of the country. 

Local media said a fierce storm, including water spouts, had battered the area overnight but skies were clear and seas calm by Monday morning.

The ANSA news agency said the yacht, built in 2008 by the Italian firm Perini Navi, had been moored off the port at Porticello.

The yacht had won a string of awards for its design and can accommodate up to 12 guests in six suites and a crew of 10, according to online specialist yacht sites.

The Bayesian was known for its single 75-meter mast, one of the world’s tallest made of aluminium and which was lit up at night, just hours before it sank.

The Bali 5.4 is a "Multihull of the Year" award-winning catamaran. The design was new to the market in 2019 and provided a fresh approach to sailing. It is revolutionary in how space is accessed, with deliberate attention to flow and open space and it succeeds in producing a scale that feels less like a boat, and more like an upscale floating condominium. Bali catamarans are known and appreciated for their unparalleled success in blending luxury, space, and performance; producing a sailing experience that is unparalleled. This new design further capitalizes on that reputation with the advent of the "Bali garage door" that is the centerpiece of the yacht. It allows for the aft wall of the yacht to simply disappear, opening up the back of the yacht to an unobstructed view of paradise. This also affords indoor/outdoor dining options and gives the ever-present Caribbean breeze ample opportunity to make its way through the yacht with ease. With her solid foredeck gone are the forward trampolines, replaced by a large relaxing lounge area complete with cushions for sunbathing. A full-sized door provides access directly from the lounge area into the salon, allowing free movement through the yacht. A walk up to the flybridge unveils a seating area perfect for cocktails and taking in sunsets. There is also another area for sunbathing on the flybridge where you can take in the sights of the islands from the highest vantage point on the yacht. The Bali open space design is further complimented by the superior outfit and aftermarket items available on Ad Astra. No detail has been left unnoticed from the fine linens to the serving and flatware and crystal wine glasses that make every meal feel luxurious. She has been given every appliance and kitchen accessory to allow the chef to fully showcase the mastery of their skill set. The water toys abound, allowing guests to fully experience all the Caribbean has to offer, both in and out of the water. Ad Astra will accommodate 10 charter guests in 5 spacious queen cabins. Captain: Evanne Soeten

Evanne grew up in the Netherlands, near the water where she cruised the beautiful Dutch channels with her parents from a young age. Exploring coastal cities, islands, sailing, and water sports have been a big part of her life since she was young, making her happy and fostering her passion for the sea and everything related to it.

After graduating from International Hospitality Studies & Entrepreneurship, she jumped into the restaurant industry, working as a hostess, barista, and mixologist. Her passion for wine led her to the Wine Academy in Amsterdam, where she completed the Wine & Spirits Educational Trust. Over the next few years, she worked as a sommelier at various Michelin-starred restaurants in the Netherlands and Denmark, including Geranium, the World's Best Restaurant of 2022.

Evanne's love for the sea never faded, so she specialized in sailing and earned her RYA Yacht Master Offshore in South Africa. She gained valuable experience working with the Yacht Week in Croatia and Greece. During this time, she and her partner Stijn discovered the yachting industry and realized they wanted to turn their shared hobbies and passions into a profession. Evanne decided to leave her job as a sommelier to pursue her dreams in the STRA yachting industry as a skipper. ..read more

Growing up in the south of the Netherlands, Stijn always had a passion for cooking. Even as a child, he knew that this was what he wanted to do. He started honing his skills early, taking lessons from top chefs and eventually graduating from The Cas Spijkers Academy, one of the best culinary schools in the Netherlands known for its French culinary techniques.

After graduation, Stijn dove straight into the world of Michelin-starred restaurants, refining his craft across the Netherlands. His culinary journey didn't stop there, though. He ventured to Norway and Denmark, embracing Nordic cuisine and rising to a leading position at a restaurant in Denmark.

But cooking wasn't Stijn's only love—he had a strong sense of adventure too. He traveled across Asia for a year, constantly seeking new experiences and flavors. Stijn's adventures eventually led him to the Mediterranean, where he completed his first yachting season. Inspired by the experience, he decided to pursue private cooking in the British Virgin Islands. There, he cooked on estates and private islands like Necker Island and Moskito Island.

After another season in the Mediterranean, Stin is excited to return to the Virgin Islands, T'RA ready to continue his culinary journey on the water.

PLEASE READ THESE TERMS AND CONDITIONS (“ Terms ”) CAREFULLY AS THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES AND OBLIGATIONS AS WELL AS A SECTION GOVERNING THE JURISDICTION AND VENUE OF DISPUTES. THESE TERMS ALSO CONTAIN A LEGALLY BINDING RELEASE, WAIVER OF LIABILITY, AND ASSUMPTION OF RISK. By creating a username, a login, clicking submit, using the services of Charter Experts, LLC d/b/a Virgin Island Sailing® (“ Broker ) or by accessing Broker’s website, you agree that you have read, and acknowledge your acceptance of these Terms. The Terms are subject to change at any time without notice at Broker’s sole discretion. Additionally, any transaction for which you have made payment shall be governed by the form of Terms in effect at the time of such payment notwithstanding any subsequent changes hereto.

If you are obtaining a quote, information, booking travel for and/or securing or procuring a Charter (as that term is defined in Section 1 below) for more than just yourself, all references below to “Charterer” or “you” (and derivations thereof) shall be read to mean you on behalf of yourself and each individual within your group for whom you are obtaining a quote, information, booking travel for and/or securing or procuring Charter.

These Terms shall be read together and construed, to the fullest extent possible, to be in concert with any other agreement by or among Broker and Charterer. To the extent they cannot be so construed, then in the event of any direct conflict between these Terms and any other agreement by or among Broker and Charterer (including but not limited to the agreement executed by Charterer for a Charter Reservation (as that term is defined in Section 1 below), these Terms shall prevail.

  • Prepaid Charter Reservations . Typically, Broker negotiates charter rates in advance with the yacht owner or charter company (“ Charter Provider ”) to obtain cost-effective rates, and facilitate reservations and availability for yacht charters, excursions and travel (the “ Charter ”). Broker also provides services to you by facilitating the booking of reservations for consideration and receives a commission from the Charter Provider (the “ Broker Fee ”). The Broker Fee is included in the pre-negotiated Charter rate provided to you, plus taxes and other fees where applicable. You agree that your payment is for the total amount set forth in the applicable Charter agreement (which Charter Provider may refer to as a Charter Contract, Charter Agreement, Booking Terms & Conditions, Instructions and Terms for Accommodations, as well as other derivations) provided to you by Broker (“ Charter Agreement ”). Upon execution of the Charter Agreement and receipt of the applicable deposit, you will have made a reservation for the Charter that authorizes Broker to facilitate the Charter on your behalf (“Charter Reservation”), including making payment arrangements with the Charter Provider. You further agree that Broker is a third-party beneficiary to the Charter Agreement and shall have the right to enforce such agreement to the extent it deems such enforcement necessary or advisable to protect its rights hereunder or under the Charter Agreement.

  Broker retains the Broker Fee as compensation in arranging your Charter Reservation. The Broker Fee varies based on the amount and type of Charter and/or services provided by Broker.  By making a Charter Reservation, you accept and agree to the relevant cancellation and no-show policy of the Charter Provider set forth in the Charter Agreement. Cancellation and no-show policies vary for each Charter. Carefully read the Charter Agreement and additional information provided to you by Broker. It is expressly agreed by Charterer that the Broker Fee is earned at the time the Charter Reservation is made. Late payment, wrong credit card or debit card details, invalid credit or debit cards, or insufficient funds are for your own risk and account, and you will not be entitled to any refund of any prepaid amount unless the Charter Provider expressly agrees otherwise under the Charter Agreement or in some other signed writing.

  • Charter Rules and Restrictions . Additional terms and agreements will apply to your Charter Reservation and any purchase or rental of equipment or other items, supplies, provisions and travel you may select. Please read those additional terms carefully. In particular, if you have purchased airfare, please ensure that you read the full terms and conditions of carriage issued by the supplier. You agree to abide by the terms of purchase imposed by any supplier with whom you elect to deal, including but not limited to payment of all amounts when due and compliance with the supplier’s rules and restrictions regarding availability, charges, fares, and use of products and services.
  • Payment . All payments must be made by personal check, bank/wire transfer, ACH payment and/or with a major credit card unless otherwise expressly stated. The total price for the Charter Reservation will be billed in U.S. Dollars unless otherwise stated. Some banks and credit card companies impose fees for international transactions. If you are making a reservation from outside of the United States on a US credit card, your bank may convert the payment amount to your local currency and charge you a conversion fee. This means the amount listed on your credit or bank card statement may be in your local currency and therefore a different figure than the amount provided by Broker for the Charter Reservation. In addition, a foreign transaction fee may be assessed if the financial institution that issued your credit card is located outside of the United States. Booking international travel may be considered to be an international transaction by the financial institution or card company. The currency exchange rate and foreign transaction fee is determined solely by your financial institution on the day that it processes the transaction. If you have any questions about these fees or the exchange rate applied to your booking, please contact your financial institution. Broker shall not be liable to you for any such service, conversion, or exchange fee.

  Broker expressly reserves the right to cancel your Charter Reservation if full payment is not timely received as set forth in the Charter Agreement.

  • Cancellation and Rescheduling . You may cancel or change your Charter Reservation as set forth in the Charter Agreement by and among you, the Charter Provider and/or Broker. Please note that some Charter Providers do not permit changes to or cancellation of reservations after they are made, or after a certain date, as indicated in the Charter Agreement. You agree to abide by the terms of the Charter Agreement with respect to your Charter Reservation. Broker will not be responsible for reimbursing Charterer for any previously tendered deposits or payments by Charterer and disclaims all liability for the failure of a Charter Provider to refund or return any such funds.
  • Credit Card Transactions and Chargebacks . If for any reason, any Charter Provider is unable to provide the Charter, or any part thereof, for which you have contracted, your remedy lies against the Charter Provider, and not against Broker. However, Broker will use reasonable efforts to assist you and Charter Provider in reaching a resolution to a dispute between you and the Charter Provider. In the event that your payment has already been transferred from Broker to Charter Provider or to an escrow account, you agree that you will not seek a chargeback against Broker for such amounts transferred. You further agree to indemnify and hold Broker harmless from and against any liability, loss, damage or expense (including without limitation, reasonable attorneys’ fees) that Broker may incur in connection with chargebacks against Broker or under the Charter Agreement and your performance thereunder. If Broker incurs any costs, including but not limited to attorneys’ fees, to recover any payments charged back by your credit card company or other financial institution, you agree that you will be liable for these costs. If your payment is declined for any reason, you agree to settle any amounts owed to Broker via money order, cashier’s check, personal check or bank/ACH transfer immediately.
  • Broker Responsibility . Broker makes arrangements with the Charter Provider. Broker additionally makes additional arrangements with other suppliers for the various components and other services that comprise your Charter (“Charter Suppliers”). Broker is not an agent of these Charter Providers or the Charter Suppliers (and the Charter Providers and Charter Suppliers are not agents of Broker). Broker expressly disclaims any liability for the actions or omissions of the Charter Provider and the Charter Suppliers. The Charter Providers and the Charter Suppliers reserve the right to refuse service to you at their sole discretion. Broker assumes no liability for the acts of the Charter Provider or the Charter Suppliers in refusing service. Broker is not responsible for schedule changes and does not offer compensation for those changes. Broker is not responsible under any circumstances for any injury or damages you may suffer, in connection with sea, air or ground transportation, hotel accommodations, or other travel or excursion services arranged by Broker.

  You understand Broker is not the source or supplier of the Charter or other travel services you requested and acts solely as a broker for the Charter Provider and the Charter Suppliers. You agree that the Charter Provider and Charter Suppliers whose names appear in the information supplied to you are those who are solely responsible for providing the Charter you purchase. You consent to and request the use of the Charter Provider and the Charter Suppliers and agree to not hold Broker responsible should any of them: (i) fail to provide the Charter or travel services you purchased, whether or not such services are listed in the Charter Agreement or otherwise, (ii) fail to comply with any applicable law, or (iii) engage in any negligent act or omission that causes you any sort of injury, damage, delay or inconvenience.

By using Broker’s services, you waive and release any claim against Broker, its affiliated and subsidiary companies, and their respective officers, directors, employees, contractors, and agents, arising out of or in connection with any loss of or damage to property or injury to any person caused by reason of (i) any defect, negligence, or other wrongful act or omission, or any failure of performance of any kind, by any Charter Provider, Charter Suppliers, or any other provider of sea, airline, hotel, ground transportation or any other travel provider connected to or otherwise associated with the Charter, (ii) any claim for inconvenience, loss of enjoyment, mental distress or other similar claim, (iii) any delayed departure, missed connection, substitute accommodation, termination of service or change in fares or rates, and (iv) overbooking, flight or other travel cancellation, lost or misconnected personal property, or any claim arising out of the air transportation portion of your travel, and (v) or any other claim arising out of or otherwise related to the Charter Agreement or services provided by the Charter Provider and the Charter Suppliers.

Excepting only liability that directly arises from the gross negligence or willful misconduct of Broker, you will not hold Broker responsible for any injury, damage or loss you may suffer while on a Charter, whether incurred on the Charter or in connection with any other rental, purchase, excursion or activity, regardless of the relationship of any of the foregoing with the Charter Provider or the Charter Suppliers.

  • Your Responsibility . By booking a Charter with Broker, you agree to defend and indemnify and hold harmless Broker, Charter Provider, Charter Suppliers, and each of their respective officers, directors, employees and agents, from and against any and all claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature, including but not limited to reasonable legal fees, arising out of or in connection with: (i) your breach of these Terms or the documents referenced herein; (ii) your violation of any law or rights of a third party; or (iii) your use of the Broker website.

You will review your Charter Agreement and travel documents for accuracy upon receipt. You understand that it is your responsibility to review the accuracy of all details in the Charter Reservation provided to you, and that you may contact Broker if you have any questions.

You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s).

You understand that Broker recommends purchasing travel insurance to cover certain risks inherent in travel such as supplier bankruptcy and the inability to travel due to a medical or personal emergency.

  • No Warranties . All Charters, products, services, advice and information is provided on an “as is” and “as available” basis without warranties of any kind, either expressed or implied to the fullest extent permitted under the law, including but not limited to, warranties of title or implied warranties of merchantability, satisfactory quality or fitness for a particular purpose. Without limiting the above, no warranty or guarantee is made (i) regarding the acceptance of any reservation request or Charter Reservation; (ii) regarding the availability of Charters, or any other product and/or services through Broker; (iii) that the use of Broker’s website will be error-free; or (iv) regarding the completeness, accuracy, reliability or quality of any information, content, data, service, advice or merchandise provided by Broker or through Broker’s website.

Broker has no special knowledge regarding the Charter Provider’s or Charter Supplier’s financial condition, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel during or otherwise in connection with your Charter.

  • Limitation on Liability . In no event shall Broker, Charter Provider, Charter Suppliers, and/or their respective affiliates, or any employees, agents, officers, directors, members or managers of any of the foregoing (“Broker and Charter Releasees”), be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of, or in any way connected with, your access to, display of or use the Broker’s website, the Charter or services provided to you in connection with the Charter (including, but not limited to, your reliance upon opinions of the Broker), whether based on a theory of negligence, contract, tort, strict liability, consumer protection statutes, or otherwise, and even if Broker and/or any other of the Broker and Charter Releasees have been advised of the possibility of such damages.

If, despite the limitation above, Broker or the Broker and Charter Releasees are found liable for any loss or damage which arises out of or in any way connected with any of the occurrences described above, then Broker, Charter Provider, Charter Supplier and the Broker and Charter Releasees will in no event exceed, in the aggregate, the greater of (a) the Broker Fee, and (b) One-Hundred Dollars (US $100.00).

The foregoing limitation of liability reflects the allocation of risk between the parties. The limitations specified in this section will survive and apply even if any limited remedy specified in these Terms is found to have failed of its essential purpose. The limitations of liability provided in these Terms inure to the benefit of Broker and/or its providers.

The foregoing does not affect any liability which cannot be excluded or limited under applicable law.

  • Limitation on Time to File Claims . ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF RELATING TO BROKER’S SERVICES OR THE WEBSITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES, OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.
  • Waiver . No waiver by Broker of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Broker to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
  • Severability . If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
  • Governing Law and Mandatory Venue . The laws of the State of Florida govern the rights and obligations of the parties to this Agreement and the interpretation, construction and enforceability thereof. You agree that any action or proceeding initiated by Charterer against Broker shall be brought solely in the federal and state courts of Hillsborough County, Florida, and you submit to the jurisdiction of those courts and waive any objections to the exercise of personal jurisdiction over you by those courts. In the event any action or proceeding is initiated by Charterer in a court outside of Hillsborough County, Florida, Charterer agrees to pay Broker’s costs and reasonable attorneys’ fees associated with defending such action or proceeding and waives any and all defenses to the transfer of said action or proceeding, whether jurisdictional or otherwise, to a federal or state court in Hillsborough County, Florida.

Sunrise Yachts, a luxury yacht building company which is based in Turkey, has been made a main sponsor of next year’s 2011 Moscow International Boat Show (MIBS). The four-day Russian yacht show event is currently scheduled to run from April 14-17 at the Moscow’s Crocus exhibition centre.

MIBS is organised by the ITE Group and it is one of Russia’s leading boat shows and is an internationally recognised superyacht event. The show covering everything from small parts and accessories to large superyacht with over 9,000 people and 178 exhibitors attended the last year show.

The Paolo Scanu-designed Sunrise 45 yacht is an ocean-going cruising yacht that was released in 2009 to much acclaim at this was the group’s first-ever model.

Sunrise Yachts was founded in 2007 by the German entrepreneur Herbert P Baum along with the French-British yacht builder Guillaume Roché. The luxury yacht group is based in Antalya, Turkey and utilises a 10,000sq m shipyard facility. Sunrise has two sheds measuring 100m (328ft) x 16m (53ft), as well as a 70m (230ft) x 16m (53ft) fully acclimatized paint shed that can accommodate new-build and refit projects up to 65m (213ft) in length and 1,200 tonnes displacement.

Along each side of the yacht-building facility, space is available for long-term sub-contractors with the latest equipment and logistics capabilities, along with air-conditioned storage, ventilation and extraction plants. The shipyard is organized as an “assembler,” based loosely on the car industry’s model, with a small, yet powerful project management team charged with running all the in-house long-term sub-contractors.

Putin rattled after Moscow ‘under attack from biggest ever drone strike’

Moscow came under one of the largest attacks yet by Ukrainian drones since the start of fighting in 2022, further rattling Vladimir Putin as he attempts to fight Ukrainian troops in the Kursk region.

The Ministry of Defence claimed that Russia downed 45 Ukrainian drones overnight, with 11 destroyed over the Moscow region, 23 over the Bryansk region, six over Belgorod, three over Kaluga and two over Kursk.

Moscow mayor Sergey Sobyanin said on his Telegram channel: ‘This was one of the biggest attempts of all time to attack Moscow using drones.’ 

He said strong defences around the capital made it possible to shoot down all the drones before they could hit their intended targets.

Some Russian social media channels shared videos of drones apparently being destroyed by air defence systems, which then set off car alarms.

Alexander Bogomaz, the governor of the Bryansk region, which borders Ukraine, reported a ‘mass’ attack on his region but that 23 drones were destroyed.

The moment the Russians shot down a Ukrainian UJ-22 kamikaze drone with a 500 miles range.

While Ukraine has been bogged down in a land conflict in eastern Europe in which the Russians have been driving forward slowly at a heavy cost to both sides, Kyiv has also been attacking Russia with drones.

Ukraine has targeted oil refineries and airfields in an attempt to weaken Russia’s fighting potential, and has also targeted the capital several times.

The drone attacks come as Ukrainian forces are continuing to push into Russia’s western Kursk region.

The daring incursion into Russia has raised morale in Ukraine with its surprising success and changed the dynamic of the fighting.

But it is uncertain how long Ukraine will be able to hold the territory it has seized in Kursk.

It has also opened up another front in a fight where Ukrainian forces were already badly stretched.

The gains in Kursk come as Ukraine continues to lose ground in its eastern industrial region of Donbas.

The Institute for the Study of War, a think tank based in Washington, said in its daily report late on Tuesday that the Ukrainians had made additional advances in their incursion, now in its third week.

The Russian state news agency Tass reported that 31 people had died since Ukraine’s attack on Russia began on August 6, citing an unnamed source in the medical service – figures which are impossible to verify.
