Four Yacht Victims Likely Died After Depleting Air Pocket In Sunken Italian Ship: Reports

Four of the seven people killed when a luxury yacht sank off Italy’s coast last month likely died after depleting a pocket of air they had found while trapped inside the submerged ship, according to several reports.

Autopsies found that the victims — Morgan Stanley International chairman Jonathan Bloomer, his wife Judith, lawyer Chris Morvillo and his wife Neda — likely died from suffocation following the Aug. 19 sinking, Reuters reported Thursday citing judicial sources.

None of these four victims, who were found in the same cabin, had water in their lungs, suggesting they didn’t drown, the BBC also reported citing Italian news agency Ansa.

This type of death was described as “dry drowning,” which is when all of the available oxygen is consumed, leaving only carbon dioxide, CNN similarly reported citing local media.

The autopsies of two of the other victims, British tech star Mike Lynch and his 18-year-old daughter, are expected to take place on Friday. The autopsy of the ship’s onboard chef, Recaldo Thomas, has been delayed pending contact with his family in Antigua, CNN reported.

The 184-foot British-flagged ship was carrying 22 people when it was hit by a violent storm while anchored off the coast of Sicily in the early morning hours, causing it to capsize and sink within minutes, authorities previously said.

Of those on board, 15 were rescued by the Italian Coast Guard. The survivors included Lynch’s wife, Angela Bacares, who Reuters previously reported owns the firm that the yacht is listed under.

The group had been celebrating Lynch’s recent acquittal of fraud and conspiracy charges related to the $11 billion acquisition of his software maker Autonomy to Hewlett Packard in 2011, survivors have said.

An investigation remains underway into the cause of the ship’s sinking, including whether it was caused by human error.

Autopsies suggest four victims on Mike Lynch’s yacht died of suffocation

PALERMO – Initial examinations of four of the people killed when British tech tycoon Mike Lynch’s family yacht sank off Sicily in August indicated they had died of suffocation as oxygen ran out on the stricken vessel, judicial sources said on Sept 5.

Mr Lynch, his daughter Hannah, an onboard cook and four guests died when the Bayesian, a British flagged 56m-long superyacht, sank during a severe and sudden weather event off the port of Porticello, near Palermo, on Aug 19.

First results from autopsies on four of the victims – Morgan Stanley International chairman Jonathan Bloomer, his wife Judith, lawyer Chris Morvillo and his wife Neda – suggested that they died from suffocation, having been trapped on the ship.

More forensic tests were ordered, with results expected in the coming weeks, the sources said.

Examinations on the bodies of Mr Lynch and his daughter were due to begin later on Sept 5, they added.

The bodies of the dead, except for the cook, were found in the cabins on the left-hand side of the boat, where the passengers may have tried to search for remaining bubbles of air, the head of Palermo’s fire brigade said in August.

Mr James Cutfield, the ship captain, and crew members Tim Parker Eaton and Matthew Griffiths have been placed under investigation by the Italian authorities for potential manslaughter and shipwreck.

Being investigated does not imply guilt and does not mean formal charges will follow.

Mr Griffiths, who was on watch duty on the night of the disaster, told investigators that the crew members did everything they could to save those on board the Bayesian, according to comments reported by Italian news agency Ansa last week.

The sinking has puzzled naval experts, who said a vessel such as the Bayesian, built by Perini, a high-end yacht manufacturer owned by The Italian Sea Group, should have withstood the storm and, in any case, should not have sunk as quickly as it did. REUTERS

Details have emerged of the 22 people who were on board the superyacht that sank off the coast of Sicily.

The British-flagged vessel named Bayesian was carrying 12 passengers and 10 members of crew when it got into difficulty in the early hours of Monday.

Seven bodies have now been recovered. The other 15 people on board were rescued.

British technology tycoon Mike Lynch was among the original six people missing. On Thursday, divers confirmed his body had been recovered.

Raised in Ilford, east London by Irish parents, the 59-year-old made millions with the software company Autonomy he set up in 1996.

He had an estimated net worth of £852m, according to the 2023 Sunday Times Rich List, and is believed to have owned the yacht.

Off the back of Automomy's global success, Mr Lynch was given the roles of science adviser to former prime minister David Cameron and non-executive director of the BBC.

The Cambridge maths and sciences graduate sold the firm for £8.64bn to US giant Hewlett Packard (HP) in 2011.

Dubbed the "British Bill Gates", Mr Lynch has been in the headlines in recent months over a high-profile fraud case related to the sale of Autonomy to HP in 2011.

HP accused him of deliberately overstating the value of the company before it was acquired by the American technology firm. Mr Lynch denied any wrongdoing.

In June, a US jury cleared him of all charges .

Hannah Lynch

Mr Lynch's 18-year-old daughter Hannah Lynch was also on board. A body believed to be that of the teenager was recovered on Friday from the yacht wreckage.

She had been on holiday with her parents, having secured a place to study English at the University of Oxford, according to reports.

Her former school, Latymer Upper School in Hammersmith, west London, said they were "incredibly shocked by the news that Hannah and her father are among those missing in this tragic accident" when the yacht first sank.

Angela Bacares

Mr Lynch's wife Angela Bacares was on board the yacht and was rescued.

The 57-year-old said she and Mr Lynch were awoken by the boat "tilting" at 4am - half an hour before it sank.

Jonathan Bloomer

Jonathan Bloomer, the chairman of investment bank Morgan Stanley International, was confirmed dead on Thursday.

According to the Financial Times, Mr Bloomer appeared as a defence witness for Mr Lynch during his US criminal trial and the pair were good friends. He also chaired Autonomy's audit committee.

The 70-year-old was the chief executive of UK-Hong Kong insurer Prudential until he was ousted by the board in 2005.

He was also chairman of the insurance provider Hiscox.

Judy Bloomer

Mr Bloomer's wife Judy was on the yacht trip with her husband. Divers confirmed they found her body on Thursday.

Mrs Bloomer was a former board member at The Eve Appeal charity, which focuses on gynaecological cancers.

The charity described her as a "brilliant champion for women's health and medical research... an incredible supporter, committee member, and trustee of our charity for over 20 years".

Recaldo Thomas

The yacht's on-board chef Recaldo Thomas died in the sinking.

He was Canadian-Antiguan and part of the crew of the Bayesian.

His body was the first to be recovered from the wreckage.

US lawyer Chris Morvillo was among those divers found dead on Thursday.

The father-of-two worked on Mr Lynch's US fraud trial and was a partner of law firm Clifford Chance's US branch.

Mr Morvillo was assistant attorney for the Southern District of New York between 1995 and 2005 and worked on the terrorist investigation into the 9/11 attacks.

In a recent LinkedIn post, he thanked the legal team that helped win Mr Lynch's trial.

Signing off the post, he said: "And, finally, a huge thank you to my patient and incredible wife, Neda Morvillo, and my two strong, brilliant, and beautiful daughters, Sabrina Morvillo and Sophia Morvillo.

"None of this would have been possible without your love and support. I am so glad to be home. And they all lived happily ever after…."

Mr Morvillo's wife Neda died in the disaster alongside her husband.

The 57-year-old had a luxury jewellery brand, which she ran under her maiden name Neda Nassiri.

Ayla Ronald, a senior associate at Clifford Chance, survived the yacht disaster, the law firm confirmed.

The 36-year-old worked alongside Chris Morvillo in helping defend Mike Lynch in court.

Clifford Chance said in a statement: "Our utmost priority is providing support to the family as well as our colleague Ayla Ronald, who together with her partner, thankfully survived the incident."

She is originally from Christchurch, New Zealand, but lives in London, her father told local media there.

He said she was left "very shaken" but "she and her partner are alive".

Charlotte Golunski

Charlotte Golunski

Charlotte Golunski was on board the yacht and was rescued along with her one-year-old daughter, Sofia.

She spoke to Italian newspaper La Repubblica, confirming she survived the yacht sinking and told how she kept her daughter alive after she was rescued.

"I held her afloat with all my strength, my arms stretched upwards to keep her from drowning," she said.

"It was all dark. In the water I couldn't keep my eyes open. I screamed for help but all I could hear around me was the screams of others."

The 35-year-old is a partner at one of Mr Lynch's firms - Invoke Capital - and has worked there since 2012, according to her LinkedIn profile.

She also worked at Hewlett Packard, which acquired Autonomy in 2011, for 11 months.

Before that, she studied history at the University of Oxford.

James Emsley

Ms Golunski's partner James Emsley was also rescued from the yacht, according to Sicily's civil protection agency.

The 36-year-old is the father of her one-year-old daughter.

James Cutfield

The 51-year-old captain of the yacht spoke to Italian newspaper La Repubblica after he was rescued.

Mr Cutfield, from New Zealand, was taken for treatment at the Termini Imerese emergency unit, where he told the newspaper: "We didn't see it coming."

Leah Randall was part of the Bayesian crew and survived the sinking.

She was pictured going ashore in Porticello on Monday morning and is from South Africa.

Her mother Heidi told Sky News said she was "beyond relieved that my daughter's life was spared by the grace of God".

"It doesn't make it any easier living with the heartache of those who have lost their lives [or are] missing. My very deepest condolences to the chef's family as they formed a great friendship," she said.

Katja Chicken was another South African member of crew on board the Bayesian and was pictured being brought to safety in Porticello on Monday.

Less than a month after the businessman died aboard the luxury yacht that sank off the coast off Sicily , Hewlett Packard Enterprises (HPE)—who filed a $6.5 billion claim against the former Autonomy CEO and Autonomy's former chief financial officer Sushovan Hussain in the U.K. in 2015—revealed it will continue to pursue damages of up to $4 billion from Lynch's estate, according to a statement from HPE that was obtained by E! News Sept. 4. 

The decision to move forward with the legal case comes after Britain’s High Court ruled in 2022 that Hewlett Packard “had substantially succeeded in its civil fraud claims,” per the company's statement. 

And Hewlett Packard—which accuse Lynch and Hussain in their lawsuit of fraudulently over-valuing Autonomy when selling it to the company for $11 billion in 2011—was confident that the judge's "decision regarding damages" will be issued "in due course." 

However, the court's final decision has yet to be made, and Judge Robert Hildyard previously said he expected the amount Hewlett Packard will win in damages to be "substantially" less than what the company sought, per AP. (Lynch was also notably acquitted in a separate U.S. trial related to Autonomy's sale months before he boarded the Sicily yacht.)

Still, if Hewlett Packard wins the case, Lynch's wife Angela Bacares —who was rescued after the sinking that killed her husband and their 18-year-old daughter Hannah Lynch —could be the one stuck paying for the damages if she is the beneficiary of his estate. 

E! News reached out to a rep for the Lynch family for comment but has not heard back. 

Bacares, Lynch and their daughter were three of the 22 total people—12 guests and 10 crew members—aboard the 184-foot Bayesian yacht when it sank Aug. 19 off the coast of Sicily, Italy —an incident that maritime experts have described as anomalous.

The tragedy, which occurred due to harsh weather conditions, left five others dead in addition to Lynch and Hannah: cook Recaldo Thomas , spouses Christopher Morvillo and Neda Morvillo , as well as Morgan Stanley International Chairman Jonathan Bloomer and his wife Judy Bloomer . 

Following the boat's sinking, the ship's captain, James Cutfield , became the subject of an investigation for manslaughter, his lawyer confirmed to NBC News. He has yet to be charged with any crime, and the investigation does not suggest that any charges will follow.

As for Bacares, her surviving daughter Esme Lynch has since spoken out about the immeasurable loss they feel over the deaths of Mike and Hannah. 

"She is my little angel, my star," Esme said of her younger sister in an Aug. 25 statement to Sky News . "She had even more love to give endlessly to all her friends and passion to give to her incredible studies and goals."

Crew members on Mike Lynch yacht tell of moments it sank off Sicily

ROME (Reuters) -Crew members on Mike Lynch's yacht have spoken of the moments when a storm sank the vessel off Sicily and their efforts to help save passengers, after a disaster that killed the British tech tycoon and six other people.

Matthew Griffiths, who was on watch duty on the night of the disaster two weeks ago, told investigators that the crew members did everything they could to save those on board the Bayesian, according to comments reported by Italian news agency Ansa on Saturday.

Griffiths, the boat's captain James Cutfield, and ship engineer Tim Parker Eaton have been placed under investigation by the Italian authorities for potential manslaughter and shipwreck. Being investigated does not imply guilt and does not mean formal charges will follow.

"I woke up the captain when the wind was at 20 knots (23 mph/37 kph). He gave orders to wake everyone else," Ansa quoted Griffiths as saying.

"The ship tilted and we were thrown into the water. Then we managed to get back up and tried to rescue those we could," he added, describing the events of the early hours of Aug. 19, when the Bayesian had been anchored off the Sicilian port of Porticello.

"We were walking on the walls (of the boat). We saved who we could, Cutfield also saved the little girl and her mother," he said, referring to passenger Charlotte Golunski and her one-year-old daughter. In all there were 15 survivors of the wreck.

Cutfield exercised his right to remain silent when questioned by prosecutors on Tuesday, his lawyers said, saying he was "worn out" and that they needed more time to build a defence case.

Before this, Cutfield gave a similar description to Griffiths' to investigators, according to comments reported on Sunday by Italian daily Il Corriere della Sera.

Cutfield said the boat tilted by 45 degrees and stayed in that position for some time, then it suddenly fell completely to the right, the newspaper reported.

Parker Eaton had not previously commented on the investigation. On Sunday, Il Corriere quoted him as saying that all doors and hatches were closed when the storm hit the boat, except one giving access to the engine room.

That door was located on the side opposite to the tilting and so could not be a factor causing the sinking, he said.

Prosecutor Raffaele Cammarano said last week that the vessel was most likely hit by a "downburst", a very strong downward wind.

The sinking has puzzled naval marine experts, who said a vessel like the Bayesian, built by Italian high-end yacht manufacturer Perini, should have withstood the storm and, in any case, should not have sunk as quickly as it did.

Prosecutors in the town of Termini Imerese, near Palermo, have said their investigation will take time, with the wreck yet to be salvaged from the sea.

The captain and a sailor and engineer have spoken with investigators, according to Italian news media

The captain and two crew members now under investigation in connection with the sinking of the yacht  Bayesian  off the coast of Sicily last month are reportedly sharing some of what they say happened as the tragedy unfolded, ultimately killing seven aboard .

According to multiple Italian news outlets, sailor Matthew Griffiths, who was on watch duty at the time, and Tim Parker Eaton, the ship’s engineer, as well as captain James Cutfield have each spoken with investigators about what led up to the  Bayesian  going into the water.

The Italian coast guard previously said the vessel sank around 5 a.m. local time on Aug. 19 after a "violent storm" while near Porticello in northern Sicily.

Twelve passengers and 10 crew were aboard: Six of the passengers — including British tech businessman Mike Lynch and his daughter Hannah as well as two couples — were killed along with the yacht’s chef, Recaldo Thomas.

Griffiths, speaking with investigators, said that “I woke up the captain when the wind was at 20 knots [23 mph]. He gave the order to wake everyone else up,” according to the  La Stampa  newspaper.

“Then I put away the cushions and plants,” Griffiths is quoted as saying. “I closed the glass windows of the lounge at the bow as well as the hatches.”

Prosecutor Raffaele Cammarano has previously referred in a press conference to a "sudden and unexpected event" of weather before the sinking and said the yacht had been "hit by a downburst."

Italian TV network RAI quoted Griffiths as telling investigators that the yacht’s crew all went into the sea because of the weather but “managed to climb back on board.”

"The ship tilted and we were thrown into the water. Then we … tried to save those we could,” he said, per  La Stampa .

“The boat was tilted and we were walking on the walls,” he said. Similar comments were also reported by ANSA , an Italian news agency.

Cutfield likewise said the  Bayesian  listed 45 degrees and then fell sharply to the right, according to what he told investigators as quoted by the  Corriere della Sera  newspaper.

According to RAI, citing what Griffiths told authorities, some of the crew created a kind of human chain to reach the passenger area from the  Bayesian ’s bridge in order to get some people off the yacht.

Eaton, the engineer, told investigators that the  Bayesian ’s hatches were closed when the weather hit, except for an entry to the engine, as quoted by  Corriere della Sera .

It remains unclear how and why the superyacht succumbed to the weather in what some witnesses have said was mere minutes. 

The  Bayesian ’s captain and Parker Eaton and Griffiths have reportedly all been placed under investigation for potential multiple manslaughter and negligent shipwreck charges — but that is not the same as being charged with a crime and none of the men have been formally accused of wrongdoing.

They have not commented publicly.

Borner, captain of the  Sir Robert Baden Powell , whose boat was nearby at the time, previously told PEOPLE that he noticed the weather deteriorated very rapidly around 3 a.m. local time on Aug. 19. 

“The weather turned very quickly and reached us even more quickly,” he said. “And the  Bayesian  was there at the time. It was anchored like us. We kept an eye on it. We had turned the engine on to maintain our position in case the anchor didn’t hold and were carefully watching it to keep at a distance from it as well. We were the only two ships out in the bay.”

Borner and a passenger saw a red flare and then a white one. It prompted Borner and his first mate to board a tender, and they headed in the direction where the  Bayesian  had been. 

“We first found things floating in the water like cushions and chairs and stuff,” Borner said. “And then we saw a flickering light. This was a life raft with a light on the top. And they also waved at us with a torch.”

“So we went there,” he added, “and then we found the crew and part of the passengers — 15 people in a 12-person raft, including a little baby .”

Von der Segeljacht selbst wurde offenbar kein Notruf abgesetzt. «Zu keinem Zeitpunkt gab es irgendwelche Lebenszeichen oder Lichter, etwa von Schwimmwesten oder Schwimminseln», sagte ein Sprecher der DGzRS.

Suche in Nordsee eingestellt – Ermittlungen aufgenommen

Die beteiligten Einheiten suchten bei geringem Seegang und wenig Wind, aber starkem Regen und entsprechend erschwerten Sichtverhältnissen das mehrfach aktualisierte Suchgebiet systematisch ab. Im Einsatzgebiet herrschte eine Wassertemperatur von etwa 18 Grad Celsius. Gegen 7.20 Uhr stellte JRCC Den Helder die Suche bis zum Eintreffen neuer Erkenntnisse ein.

Niederländische Polizeibehörden haben Ermittlungen zur Unglücksursache aufgenommen.

Borkum (dpa/lni) - Eine Segeljacht ist nach einem Brand auf hoher See gesunken. In der Nacht zu Mittwoch meldete ein Serviceschiff eines Windparks die Jacht, die brennend umhertrieb, wie die Deutsche Gesellschaft zur Rettung Schiffbrüchiger (DGzRS) mitteilte. Das Schiff befand sich demnach zu dem Zeitpunkt rund 90 Kilometer nordwestlich von Borkum nahe dem Windpark Deutsche Bucht. Der Verbleib der Jacht-Besatzung sei unklar.

Die Rettungsleitstelle See habe sofort umliegende Schiffe informiert. Das Windpark-Service-Schiff habe das Feuer gelöscht. Kurz nach Mitternacht sei die Jacht dennoch gesunken. Fünf Schiffe der deutschen und niederländischen Seenotretter, drei Hubschrauber, ein Flugzeug sowie private Schiffe hätten anschließend in dem Gebiet mehrfach akribisch nach Überlebenden gesucht. Von der Segeljacht selbst sei kein Notruf abgesetzt worden. Die Wassertemperatur betrug 18 Grad Celsius.

„Zu keinem Zeitpunkt gab es irgendwelche Lebenszeichen oder Lichter, etwa von Schwimmwesten oder Schwimminseln“, sagte ein Sprecher der DGzRS. Zwar war die Sicht demnach wegen Regens nicht gut, es gab aber auch nur wenig Seegang. Die Suche sei gegen 7.20 Uhr eingestellt worden. „Bis es weitere Erkenntnisse gibt“, sagte der Sprecher. Zunächst habe die Polizei die Ermittlungen übernommen.

Anzahl der Menschen an Bord unklar

Wie die an dem Einsatz beteiligte niederländische Küstenwache mitteilte, sei bisher nicht bekannt, um welches Schiff es sich bei der Jacht genau gehandelt habe und wie viele Menschen sich an Bord befunden hätten. An der Jacht sei kein Identifizierungs- und Ortungssystem eingeschaltet gewesen. Die Küstenwache habe das brennende Schiff von ihrem Flugzeug aus gesichtet, aber keine Menschen an Bord oder in der Nähe der Jacht wahrgenommen.

Fünf Besatzungsmitglieder eines Bootes – darunter ein deutsches Ehepaar und sein minderjähriger Sohn – mussten an diesem Samstag vor Mallorca von ihrer Yacht gerettet werden. Der Vorfall ereignete sich vor der Bucht von Camp de Mar in der Gemeinde Andratx. Laut Angaben des Seenotrettungsdienstes befindet sich das Boot derzeit noch immer teilweise unter Wasser.

Der Vorfall ereignete sich kurz vor 10 Uhr, als der Hafenmeister von Port Adriano den Untergang einer Yacht vor der Küste von Camp de Mar meldete. Während "Salvamento Marítimo" das Rettungsschiff Salvamar Libertas aktivierte und eine Einheit der Lokalpolizei zum Unglücksort entsandte, konnte ein privates Boot die fünf Besatzungsmitglieder aus dem Wasser retten, da ihre Yacht bereits mit Wasser vollgelaufen war.

Salvamento Marítimo ist vor Ort und führt die notwendigen Maßnahmen durch. Ersten Berichten zufolge kam es zu keiner Umweltverschmutzung, und das Sinken der Yacht verläuft sehr langsam.

Sollte die Yacht auf dem Meeresgrund landen, muss ein Bergungsplan erstellt und der Capitanía Marítima von den Eigentümern vorgelegt werden, um die entsprechenden Verfahren in die Wege zu leiten.

The 5 tragic minutes that sank a superyacht

PORTICELLO, Italy — Survivors of a storm that sank a superyacht off Sicily recounted their ordeal to one of the doctors who rushed to their aid, with some saying it took mere minutes for the 180-foot ship to go down. 

Dr. Fabio Genco, head of the Palermo Emergency Medical Services, told NBC News on the phone Thursday that he arrived in the seaside village of Porticello before dawn Monday, about an hour after the $40 million Bayesian sank in the violent and sudden storm.   

Of the 22 people onboard, 15 survived despite storm conditions and darkness, climbing onto a lifeboat before being rescued by a nearby sailboat. The crew members have made no public statements so far, though some have been interviewed by investigators.

“They told me that it was all dark, that the yacht hoisted itself up and then went down,” Genco said, recounting what the survivors told him. “All the objects were falling on them. That’s why I immediately made sure, by asking them questions, if they had any internal injuries,” he said. 

It appears they had just minutes to abandon the sinking ship, Genco said.

“They told me that suddenly they found themselves catapulted into the water without even understanding how they had got there,” he said, “And that the whole thing seems to have lasted from 3 to 5 minutes.”

Giovanni Costantino, CEO of The Italian Sea Group, which owns Perini Navi, the Bayesian's shipbuilder, told Sky News that there were no flaws with the design or construction of the yacht. He said their structure and keel made boats like that “unsinkable bodies.”

In an interview with the Italian newspaper Corriere della Sera, he disavowed responsibility, blaming instead the actions of the crew. “Mistakes were made,” he said. 

Genco said one of his colleagues who arrived at the scene before him initially thought that only three people survived, but the coast guard reported there were other survivors and more emergency services were called in. 

When Genco arrived, he found scenes of panic and despair. 

“Unfortunately, we are used to such panic scenes because we are used to the shipwrecks that happen on Lampedusa ,” Genco said, referring to the island southwest of Sicily, where the wreckage of boats carrying migrants on the sea journey from North Africa to Italy are often found . 

Six of the passengers were declared missing Monday, and by Thursday, the bodies of five had been recovered from the wreck , some 160 feet underwater.

Among those who survived is Angela Bacares, wife of the British tech mogul Mike Lynch , whose body was recovered Thursday. 

Divers searching for six missing people following the sinking of a superyacht off Sicily in a storm have found fifth bodies.

Another survivor has been identified as Charlotte Emsley, 35. She told the Italian news agency ANSA that she had momentarily lost hold of her year-old daughter, Sofia, in the water but managed to retrieve her and hold her over the waves until a lifeboat inflated and they were pulled into safety.

Dr. Domenico Cipolla at the Di Cristina Children’s Hospital in Palermo is also part of a team of medical professionals treating the shipwreck survivors. He told the BBC on Wednesday that Emsley and her daughter, as well as the father of the child, who Cipolla said also survived, are continuing to receive psychological help. 

“Psychological support was constant and is constant even today, because basically it is the wounds of the soul that are the most in need of healing in these cases,” Cipolla said.

Genco also told NBC News that he was especially concerned about the child. “She did not understand anything. She was soaking wet and cold,” he said. 

Karsten Borner, the Dutch captain of the Sir Robert Baden Powell, a yacht that was anchored near the Bayesian, said by phone Wednesday that he saw a thunderstorm come in at around 4 a.m. local time (10 p.m. ET) Monday, followed by what looked like a waterspout, a type of tornado that forms over water. 

The International Centre for Waterspout Research noted on X that there was a “waterspout outbreak” off Italy on Monday, the day the Bayesian sank. 

All the men missing after a luxury yacht sank off Sicily -- who included UK tech tycoon Mike Lynch -- have been found, a coastguard official told.

“I turned on the engine and made maneuvers so that we wouldn’t collide with the Bayesian, which was anchored about 100 meters from us,” Borner said. “Then all of a sudden it disappeared. Then the wind calmed down, we looked around and saw a red flare.”

Borner said he got into his boat’s tender and saw a life raft with 15 people on it. Members of the crew were administering first aid. 

“I don’t know why it sank so quickly, but it may have something to do with the mast which was incredibly long,” he said. Questions have been raised about whether the mast was to blame for the accident as tall masts, even with the sails down, have more surface area exposed to the wind, which can contribute to tipping a vessel in a storm.

The CCTV footage that emerged Tuesday showed the yacht’s 250-foot mast, believed to be one of the tallest aluminum sailing masts in the world, lashed by the storm as it appears to tilt to one side before disappearing.

The FinCEN Files Shed New Light on a Scandalous Episode at Deutsche Bank

In January, 2019, I received a tip from someone who worked in a Japanese mountain resort. He told me that an American named Tim Wiswell had arrived on a skiing vacation with his family. Japan, he noted, had signed an extradition treaty with the U.S. My correspondent wrote, “I’m just wondering why it seems he’s not being pursued?”

It was a reasonable question. Wiswell, or “Wiz,” as he was known to his colleagues in finance, was the head of Russian equities at Deutsche Bank in Moscow until 2015. He was also, according to the bank, a key figure behind “mirror trades,” a scheme designed to expatriate and launder money of dubious provenance. In a typical mirror trade, a Russian client of Deutsche Bank would make two simultaneous orders—one to buy stock in Moscow in rubles, the other to sell an identical quantity of the same stock in London, and receive payment in Euros, pounds, or dollars. The client did not make any money on the equities maneuver. The purpose of the double-order was to move money without alerting tax inspectors, sanctions observers, or officers of the law. Between 2011 and 2015, ten billion dollars left Russia through Deutsche Bank’s mirror trades.

When the scheme unravelled, in 2015, Deutsche Bank pointed the finger of blame at Wiswell. The company’s leadership accused him of accepting nearly four million dollars in bribes to facilitate the trades—sometimes through an offshore account owned by his wife, who is an artist—on top of his generous banker’s salary. In 2016, when I investigated mirror trades, a former colleague of Wiswell’s told me that Wiswell had manipulated over-the-counter trades of equities to benefit his friends. A professional money-launderer in Moscow who was intimately acquainted with Deutsche Bank’s capital-flight service told me that, as his fee for making mirror trades, Wiswell sometimes accepted cash payments in a gym bag.

The ultimate beneficiaries of mirror trades were more difficult to discern. Those who wished to move their money commissioned professional launderers, who placed the orders on behalf of front companies. But I was told that the scheme was used both by organized criminals and by politically connected Russians and Chechens. Certainly, mirror trades would have been attractive to anyone eager to circumvent sanctions or the scrutiny of their own government. Bloomberg News named Arkady and Boris Rotenberg, close allies of Vladimir Putin who were sanctioned by the U.S. following Russia’s annexation of Crimea, as users of mirror trades—although no definitive proof has emerged of their involvement. Igor Putin, the President’s cousin, was connected to the scheme.

The recently published FinCEN files detail the extent to which major banks have facilitated money laundering and add some fascinating detail to the mirror-trades affair. The FinCEN documents are based on Suspicious Activity Reports—essentially whistle-blowing reports made by banks themselves—filed to the U.S. government. They were leaked to BuzzFeed News, then shared with the International Consortium of Investigative Journalists, which shared them with news outlets around the world. According to the documents, one of the clients involved in mirror trades was a liaison for Vladislav (Blond) Leontyev, a Russian drug trafficker. (Leontyev denied any involvement in mirror trades or other criminal activity.) Meanwhile, nearly fifty million dollars were also funnelled through mirror trades to the Khanani network, whose clients include associates of Hezbollah and the Taliban.

Deutsche Bank’s reputation was abject even before the mirror-trades scandal broke. Between 2008 and 2016, it paid around nine billion dollars in fines and settlements for a wide range of wrongdoing that included conspiring to rig the price of gold and silver, breaking sanctions in Iran, defrauding mortgage companies, and manipulating the London Interbank Offered Rate, or LIBOR . Recently, the bank was fined a hundred and fifty million dollars by the New York Department of Financial Services for “significant compliance failures” in its relationship with Jeffrey Epstein . The FinCEN files cover around two trillion dollars’ worth of suspicious transactions reported at major banks between 1999 and 2017. Of that two trillion, more than half—around $1.3 trillion—passed through Deutsche Bank.

Deutsche Bank says that it has learned from “historic issues,” and argues that it has “devoted significant resources to strengthening our controls.” The organization has already faced a reckoning of sorts over mirror trades. After the scheme was shut down in 2015, it was investigated by financial regulators in Russia, the U.K., and the U.S. The Russian investigation found that Deutsche Bank had fallen prey to an illegal scheme, and penalized the bank with a token fine of five thousand dollars—pocket change for a senior banker in its Moscow office. Britain’s Financial Conduct Authority and the N.Y.D.F.S. took the bank’s breaches more seriously. They fined Deutsche Bank a combined total of six hundred and thirty million dollars for violating anti-money-laundering laws. The mirror-trades scheme, according to the F.C.A., was “highly suggestive of financial crime.”

As we now know, mirror trades were not just suggestive of financial crime. Major criminal organizations, terrorist groups, and drug cartels used them to launder and transfer money, and benefitted more generally from this geyser of dirty money. A recent internal report at Deutsche Bank noted that the Department of Justice continues to probe the mirror-trades scheme. If so, it is a long-running investigation. In 2016, I exchanged messages with two agents—from the F.B.I. and the U.S. Department of Homeland Security—who had spent half a day in a European embassy questioning one of my sources. But nothing came of their investigation, it seems. Meanwhile, in his recently-published book about Deutsche Bank, “Dark Towers,” David Enrich quotes an F.B.I. agent who said, in 2019, that the investigation into mirror trades was still active. One wonders how active the investigation can be, if it has taken so long. There is also the political environment to consider. Before Donald Trump took office, Deutsche Bank was often the only bank that would lend to him. The chances of criminal prosecutions seem slim, at least during this Administration.

Wiswell’s recent schedule is not indicative of a man worried about arrest. After he was dismissed from the bank in 2015, he fought a wrongful-termination claim against Deutsche Bank in Moscow. (He lost.) Wiswell then moved to Bali, where he ran a Russian-owned surf school, and where he apparently still lives. Last year, he went to Japan, to go skiing, and to Florence, Italy, with his wife, for the art Biennale. She posted a picture of the event on Instagram; Wiswell is holding a glass of champagne. A former Deutsche Bank employee texted me recently to say that he had heard Wiswell had been seen partying on a yacht off the southern coast of France last summer “with some Russians.” (Wiswell did not respond to a request for comment.)

Wiswell was not the only person who facilitated mirror trades. His managers turned a blind eye, either through design or incompetence. All of his immediate superiors still work in finance—although most have moved on from Deutsche Bank. Meanwhile, as BuzzFeed noted in its FinCEN reporting, Deutsche Bank’s own auditing team had investigated the Moscow equities desk in 2014. At that time, mirror trades were flourishing. The investigation gave the desk a clean bill of health, although the team left a blank space for anti-money-laundering controls and so-called know-your-customer procedures—a gross oversight. The chief of Deutsche Bank’s audit division at the time was Christian Sewing, who joined the bank when he was nineteen years old. Sewing is now the C.E.O. of Deutsche Bank.

After the mirror-trades scandal broke, Deutsche Bank’s Moscow investment arm was shuttered, and many people lost their jobs. But only three people, including Wiswell, were dismissed for their roles in mirror trades. (The scandal also precipitated the resignation of the joint C.E.O.s, Anshu Jain and Jürgen Fitschen, in 2015, but the bank was already reeling from many other shameful episodes by then.) Two junior staffers on Wiswell’s desk, whose jobs were to physically input the trades, were also dismissed.

One of those employees was a young Russian sales trader named Georgiy Buznik. Unlike some of his colleagues, Buznik appears to have been burdened with a conscience. He was often asked to execute simultaneous-buy-and-sell orders that made no economic sense to him. In fact, the clients making the mirror trades appeared to lose money, because they had to pay commissions to the bank. To Buznik, the trades raised an obvious red flag for money laundering.

On two occasions, according to his colleagues on the equities desk, Buznik took his concerns to Wiswell. His boss assured him that everything was in order and that he should continue to process the trades. Buznik did so. In 2015, when the mirror trades were exposed, he lost his job, and soon left banking. Those who worked above him at the bank continue to thrive, however, and their incompetent, unethical, or simply illegal behavior has gone unpunished. Meanwhile, dirty money continues to pump around the financial system like a pathogen. The FinCEN files, while revelatory, are also dispiriting. It’s hard to escape the conclusion: crime pays.
